8.- With which recipients will the User's data be shared?

User data may be disclosed to

  • Public Administrations in the cases provided for by law.
  • The Tropic Feel, S.L., based on the legitimate interest conferred by the data protection regulations, for administrative purposes of management of the business group. 
  • Companies related to the marketing sector or belonging to Adigital, telecommunications, financial, leisure, mass consumption, automotive, energy and water, NGOs, jewelry and precious stones, in order to send the User commercial communications, by electronic and conventional means, related to the aforementioned sectors, provided that the User authorizes it by checking the appropriate box. 

 9.- International data transfer

The User is informed that Tropicfeel does international data transfer from the US to Europe. And, has contracted the services of Shopify, Google, Microsoft, Dropbox, Mailchimp, Atlassian, Amazon Web Services, Slack, Klaviyo, among others, whose servers are hosted in the USA, which implies an international transfer of data. However, international data transfers are regular since the entities guarantee a level of protection equivalent to that offered under the RGPD. Tropicfeel has an updated policy on international transfers and will ensure that these service providers comply with the minimum security standards set by the European Commission and that they always process the data according to Tropicfeel's instructions.

10.- Data retention

The User's data will be kept for the following periods:

10.1 Data provided to formalize a purchase:

  • The data provided to manage, process, send, and follow up on purchases made will be retained during the contractual relationship and, once the contractual relationship has ended, during the statute of limitations period for any legal actions that may arise from the same. 
  • The data used to contact the User to finalize the order if he/she has saved his/her shopping cart or has saved products in his/her shopping cart without finalizing the payment process will be kept for 180 days.
  • Data relating to satisfaction and quality surveys will be retained for five (5) years.

10.2 Data provided through forms of products out of stock, will be treated until the communication is sent to the User, indicating that the product is in stock and, if it is not in stock, for six (6) months.

10.3 The data provided through contact forms will be retained for the period necessary to process and respond to your request and, once completed, during the period of limitation of legal actions arising from that request. 

10.4 Data provided through collaboration forms will be kept during the contractual relationship and, once it is terminated, during the period of limitation of legal actions that may arise from it.

10.5 Data provided for the sending of Newsletter, will be retained as long as the User does not revoke the consent given for this purpose.

10.6 Data provided to obtain discounts or to participate in promotions, will be kept until the end of the promotion and, once the promotion is over, during the period of limitation of legal actions that may arise from it.

10.7 Data used for sending commercial communications will be treated until the User opposes or revokes his/her consent.

Data used to carry out profiling, using third-party sources, in no case will refer to a period exceeding three (3) years.

11.- Commercial and promotional communications

One of the purposes for which Tropicfeel processes the personal data provided by the Users is to send them commercial communications with information regarding products, services, promotions, offers, events, or news relevant to the Users. 

If the User wishes to stop receiving commercial or promotional communications from Tropicfeel, he/she can unsubscribe from the service by sending an email to the following email address: support@tropicfeel.com.

 12.- User's Responsibility

The User:

  • Guarantees that he/she is over eighteen (18) years of age and that the information provided by Tropicfeel is true, accurate, complete and up to date. To this end, the User is responsible for the veracity of all the information provided and will keep the information provided conveniently updated, so that it corresponds to his or her real situation.
  • He/she guarantees that he/she has informed the third parties from whom he/she provides his/her data, in case he/she does so, of the aspects contained in this document. You also guarantee that you have obtained their authorization to provide their data to Tropicfeel for the aforementioned fines. 
  • You will be liable for any false or inaccurate information you provide through the Website and for any damages, direct or indirect, that this may cause to Tropicfeel or third parties.

13.- Exercise of rights

The User may send a letter to Tropicfeel, at the address indicated in the heading of this Policy, or by e-mail to the address support@tropicfeel.com, attaching a photocopy of his/her identity document, at any time and free of charge: 

  • Revoke the consents granted.
  • Obtain confirmation as to whether or not Tropicfeel is processing personal data concerning the User.
  • Access your personal data to know which are being processed and what processing operations are being carried out. 
  • Rectify inaccurate or incomplete data. 
  • Request the deletion of your data when, among other reasons, the data is no longer necessary for the purposes for which it was collected. 
  • Obtain from Tropicfeel the limitation of data processing when the accuracy, legality or necessity of the data processing is doubtful; in any case, Tropicfeel may retain the data for the exercise or defense of claims. 
  • Oppose the processing of data. 
  • Request the portability of the data provided by the User in those cases provided for in the regulations.
  • File a complaint regarding the protection of their personal data before the Spanish Data Protection Agency at the address C / Jorge Juan, 6, 28001 - Madrid, when the interested party considers that Tropicfeel has violated the rights that are recognized by the applicable regulations on data protection.

Tropicfeel will treat the User's data at all times with absolute confidentiality and will keep the mandatory duty of secrecy with respect to them, in accordance with the provisions of the applicable regulations, adopting the necessary technical and organizational measures to ensure the security of your data and avoid its alteration, loss, treatment or unauthorized access, taking into account the state of technology, the nature of the data stored and the risks to which they are exposed.

Google Analytics enables cookies in the Website domain called: 

  • "__utma": is necessary for the operation of Google Analytics and has an expiration period of 2 years.
